ale in Texas

I just read that in TX, any beer over 5% abv has to be labeled an ale, regardless if it is ale or lager.  that seems weird to me.  But the real reason I bring this up, is the other day while watching football, I decided to go up to the convenience store and pick up some beer.  They had 24 oz cans sitting in ice, so I grabbed a couple.  High Life and Icehouse.  While drinking the icehouse, I noticed it said ale on the can.  I've always thought it was supposed to be a lager.  maybe I got a can that was meant to go to Texas?  or maybe Icehouse is an ale.  Don't really see why they'd use ale yeast though, to make something that tastes mostly like a standard American Lager.  any thoughts?

that is a very stupid law...and I live in Utah so I do know all about stupid laws.
